MGANE Studio provides both wedding and commercial photography and film. Please read the section for your booking. Wedding prices, coverage and deliverables are agreed personally and recorded in the private wedding agreement. Commercial payment, delivery, licensing and portfolio rules below do not apply to weddings. Existing issued agreements retain their recorded terms.
Wedding photography & Moving Moments
Wedding bookings use the terms below and your private wedding agreement. The agreed date, venue, coverage, deliverables, total price and delivery arrangements are recorded in that agreement. The commercial terms further down this page do not apply to wedding bookings. An agreement already issued to you retains its recorded terms and booking fee; this page does not rewrite it.
For new wedding bookings: a £280 booking fee, included in your agreed total, with the remaining balance due 28 days before the wedding. Your date is confirmed after the agreement has been signed and the booking fee received while the offer is valid.
Your booking
Michael Gane trading as MGANE Studio will photograph your wedding on the date, at the venue and for the coverage recorded in your private agreement. The agreed deliverables and delivery timescale are recorded in your private agreement. These wedding terms is separate from the commercial photography terms.
Confirming the date
The £280 booking fee is part of the total price, not an extra charge. Signing and paying the £280 fee while this offer is valid confirms your booking and reserves the agreed date. Signing alone does not reserve it. Payment is a commitment to the booking, subject to the cancellation rights below. If any details are wrong, contact Michael before signing or paying.
The remaining balance
The balance is the agreed total less £280 and is due 28 days before the wedding. Michael will request the balance through your private final-details page, where you can pay securely with Stripe. For a booking made within 28 days of the wedding, the balance is due when Michael requests it. Any additional coverage or extras must be agreed with you in writing, including the price, before being charged.
Photography and delivery
Michael will work with reasonable care and skill in his documentary style. Important people, timings and requested group photographs should be discussed before the day. Individual moments cannot be guaranteed where access, weather, lighting, venue restrictions or events outside his control prevent them. Edited photographs are supplied as recorded in your private agreement; RAW files are not included unless expressly agreed.
If you cancel or change the date
Please email Michael as soon as possible. A change of date is subject to availability and written agreement. If you cancel, the booking fee may be retained towards reasonable direct losses caused by the cancellation. Any cancellation charge will reflect actual loss, including reasonable costs or lost profit, less costs saved and income from a replacement booking. Michael will take reasonable steps to reduce the loss, explain any charge, avoid double recovery and return any excess payment. Total cancellation charges cannot exceed the agreed price. Statutory cancellation rights take priority.
Statutory cancellation rights
Where the statutory 14-day cancellation right applies to your booking, you may cancel without giving a reason within 14 days after the contract is made by sending a clear statement to Michael at the email or postal address below. You may use the cancellation wording below, but do not have to. Payments will be refunded within 14 days of receiving your cancellation, using the same payment method unless you agree otherwise. If you expressly request services to begin during that period, any lawful charge is limited to the proportion actually supplied. Signing or paying alone does not waive statutory rights. Any request for an early start will be agreed separately in writing.
If Michael cannot attend
If serious illness or another unavoidable event prevents Michael attending, he will notify you promptly and discuss a suitable replacement with you. You do not have to accept a replacement. If the agreed service cannot be supplied and no alternative is agreed, payments for the unprovided service will be refunded. Your statutory rights and any other legal remedies remain unaffected.
Using your photographs
Michael retains copyright. You receive permission to download, print and share the delivered photographs for personal use. Commercial use needs separate permission. Your photographs will not be used in MGANE Studio publicity without your separate permission.
Questions, records and your rights
Please contact Michael about any concern so it can be investigated and resolved. Booking details, the agreed terms, electronic signature and payment records are retained to manage and evidence the booking, in line with the website privacy policy. Nothing in this agreement excludes rights or liability that cannot lawfully be excluded. English and Welsh law applies, without removing mandatory consumer protections or the right to bring proceedings in a court available to you under consumer law.
Coverage, photographs and short films
The Wedding Story follows the ceremony, celebrations, speeches, cake cutting and first dance through to the beginning of the evening party. Michael arrives at the ceremony location at least two hours before the ceremony. Exact coverage and finish time are agreed before booking. Preparation photographs are by special request at the ceremony venue: for one of the couple, or both only when they are in the same building, their preparation spaces are in the same immediate area and timings allow. Getting-ready locations away from the ceremony venue are not covered.
All successful wedding photographs are carefully edited and delivered in a private online gallery within two weeks of the wedding (14 calendar days), with no watermarks or download restrictions. RAW and rejected files are excluded. Any different delivery arrangement must be expressly agreed and recorded in your private agreement before booking. Please download and back up your delivered files; permanent archive storage is not included.
If Moving Moments is included, it means short filmed highlights captured alongside the photographs, rather than a full-length wedding film. The included films, formats and delivery arrangements are agreed before booking. A few requested group photographs are welcome; Michael recommends a list of no more than five and around 10–15 minutes for relaxed portraits together.
Contact and cancellation notice
Contact Michael Gane, MGANE Studio, at mganestudio@icloud.com. Your private agreement also contains the business postal address. Where a cancellation right applies, you can email a clear statement that you wish to cancel; you do not have to use a particular form.
Optional cancellation wording: “I/we give notice that I/we cancel our wedding photography contract. Booking reference: __. Wedding date: __. Client name(s) and address: __. Contract date: __. Date of cancellation: __.” A signature is needed only if you send this on paper.
Commercial photography & film terms
This section applies to business commissions, not wedding bookings.
The commercial section below applies to business photography, film and related creative commissions. Wedding bookings follow the wedding section above and the private wedding agreement instead.
1. Bookings
For a one-off commercial booking, the client reviews and signs the private agreement, then pays the agreed 30% booking deposit to confirm the booking. The deposit reserves the agreed date. Cancellation and refund arrangements are described in the commercial cancellation section and the signed agreement.
2. Payment
For one-off commercial bookings, a 30% deposit is payable after signing the agreement. The remaining 70% balance is payable no later than four weeks before the scheduled photography date. Where a booking is made within four weeks of the photography date, the remaining balance becomes due immediately after the booking deposit is received.
Larger commercial assignments, retainers, subscription services or bespoke projects may have different payment arrangements. Where these have been agreed in writing, those arrangements take precedence. Additional work requested outside the original agreed scope may be charged separately.
3. Cancellation
If the client cancels more than six weeks before the scheduled photography date, the booking deposit will be retained but no further photography fee will normally become payable. If the client cancels within six weeks of the scheduled photography date, the full agreed fee remains payable.
4. Rescheduling
Where reasonable notice is provided, MGANE Studio will make reasonable efforts to transfer the booking to another mutually convenient date. Rescheduling is subject to availability and may incur additional costs where MGANE Studio has already incurred expenses or where the nature or scope of the assignment changes. Repeated postponements may be treated as a cancellation.
5. Cancellation by MGANE Studio
In the unlikely event that MGANE Studio is unable to undertake an assignment because of serious illness, emergency or circumstances outside reasonable control, every reasonable effort will be made to agree an alternative date or appropriate solution. Where MGANE Studio cancels an assignment and an acceptable alternative cannot be provided, payments made for the affected services will be refunded.
6. Photography and Creative Approach
The client acknowledges that they are commissioning MGANE Studio because of Michael Gane’s established photographic and visual style. MGANE Studio retains creative discretion over composition, lighting, selection, processing and final presentation. The final selection of photographs delivered to the client is made by MGANE Studio. Not every photograph taken during an assignment will be delivered.
7. Editing and RAW Files
Delivered photographs will receive professional selection, colour correction, tonal adjustment and other appropriate finishing. Digital processing may involve professional photographic software and contemporary digital imaging techniques where appropriate to the commissioned work. RAW files, working files, rejected photographs and unedited images are not supplied unless specifically agreed in writing before the assignment.
8. Delivery
Final photographs will normally be delivered within 14 working days of the photography assignment unless another timescale has been agreed. Delivery will normally be through a private online gallery, digital download or another agreed electronic method. Urgent or accelerated delivery may be available by prior agreement and may incur an additional charge.
9. Storage and Backups
MGANE Studio takes reasonable precautions when handling and storing client imagery but does not provide permanent archival storage. Once the final photographs have been delivered, the client is responsible for downloading, storing and maintaining appropriate backups of the files.
10. Copyright
Unless otherwise agreed in writing, copyright in all photographs remains with Michael Gane / MGANE Studio. Payment for photography services does not constitute a transfer or assignment of copyright. Any transfer of copyright must be specifically agreed in writing and may be subject to an additional fee.
11. Client Usage Licence
Once the agreed fees have been paid in full, the client receives a non-exclusive commercial licence to use the delivered photographs for the client’s own business activities, including company websites, social media, LinkedIn, advertising, marketing, public relations, press activity, brochures, presentations, internal communications, recruitment material, exhibitions and corporate displays.
The client may not sell, separately license or commercially distribute the photographs to unrelated third parties without written permission from MGANE Studio. Reasonable resizing, cropping and placement within the client’s designs is permitted. Material alteration, manipulation or use that substantially misrepresents the original work requires prior agreement.
12. Third-Party Use
Photographs may be supplied to designers, advertising agencies, printers, web developers and similar suppliers where they are acting on behalf of the client for the client’s authorised purposes. This does not give those third parties an independent licence to use the photographs for themselves or for other clients.
13. MGANE Studio Portfolio Use
Unless confidentiality or usage restrictions have been agreed before the assignment, MGANE Studio may use photographs from commissioned work for its own legitimate promotional purposes, including its website, portfolio, social media, printed portfolio, exhibitions, awards and marketing. Where a project is confidential, commercially sensitive or subject to an embargo, the client should notify MGANE Studio before photography begins.
14. Permissions, Locations and Participants
Unless specifically agreed otherwise, the client is responsible for obtaining appropriate permission for photography at the location and for ensuring that people participating in the photography have been appropriately informed and, where necessary, have consented or otherwise been authorised to participate. Where specific model releases, property releases, location permits or other permissions are required, responsibility for obtaining them should be agreed before the assignment.
15. Travel and Expenses
Travel within any area specifically included in the quotation or package price is included. Additional mileage, rail travel, parking, accommodation, location fees and other reasonable expenses may be charged where necessary. Where reasonably practicable, these costs will be discussed and agreed with the client before they are incurred.
16. Delays and Client Cooperation
The client should provide reasonable access, information and cooperation necessary for MGANE Studio to complete the assignment. MGANE Studio is not responsible for reduced coverage or results caused by circumstances outside its reasonable control, including significant delays, restricted access, unavailable participants, venue restrictions or substantial changes to the agreed schedule.
17. Equipment and Technical Failure
MGANE Studio takes reasonable professional precautions regarding photographic equipment, data handling and backups. In the exceptional event of equipment failure, file corruption, loss or another technical problem that materially prevents delivery, MGANE Studio’s first approach will be to provide an appropriate remedy where reasonably possible, which may include rescheduling or repeating affected work.
18. Circumstances Beyond Reasonable Control
Neither party will be responsible for failure or delay caused by circumstances genuinely outside their reasonable control, which may include severe weather, serious illness, transport disruption, venue closure, government restrictions, fire, flood or other exceptional events. Where possible, the parties will work together to reschedule or find a reasonable alternative.
19. Liability
MGANE Studio will exercise reasonable care and skill in providing its services. To the extent permitted by law, MGANE Studio’s total financial liability arising from an assignment will normally be limited to the amount paid by the client for the affected assignment. MGANE Studio will not normally be liable for indirect or consequential business losses arising from circumstances outside its reasonable control.
Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or restricted.
20. Subscription and Retainer Services
Where the client purchases an ongoing photography subscription or retainer, the specific services, frequency, included shooting time, image delivery, payment schedule, cancellation arrangements and treatment of unused time will be stated in the relevant package or agreement. Those specific subscription terms will supplement these Terms & Conditions and will take precedence where there is a direct conflict.
21. Bespoke Commercial Projects
Large assignments, multi-location projects, photography and film commissions, campaigns and other bespoke work may be subject to a separate quotation, statement of work or written agreement. Where specific terms have been agreed for such a project, those terms take precedence over the corresponding provisions of these general Terms & Conditions.
22. Changes to the Assignment
Quotations are based upon the information and requirements provided at the time they are prepared. Significant changes to the location, duration, number of participants, deliverables, usage requirements or other aspects of the assignment may result in a revised quotation.
23. Complaints and Problems
If the client believes there is a problem with the delivered work or service, they should contact MGANE Studio as soon as reasonably possible. MGANE Studio will make reasonable efforts to investigate the issue and, where appropriate, agree a practical solution.
Electronic Signatures
Where MGANE Studio provides a private electronic agreement link, the client may accept the agreement electronically. Entering the requested signer details, providing an electronic signature and submitting the agreement records the client’s intention to authenticate and accept that agreement. MGANE Studio may retain the signed agreement record, signature image, date and time, agreement version and verification reference as part of its contractual business records.
24. Governing Law
These Terms & Conditions and any dispute or claim arising from them are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, subject to any mandatory legal rights that apply.
